Terms of Use

1. Acceptance of Terms

By accessing or using SinglesPop (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and SinglesPop, Inc. ("we," "us," or "our").

We may update these Terms at any time. We will notify you of material changes by updating the effective date above and, where appropriate, by email. Continued use of the Service after changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old to use SinglesPop. By creating an account, you represent and warrant that you are 18 or older, are legally capable of entering into a binding agreement, and are a resident of the United States.

The Service is currently available only to residents of the United States. We reserve the right to expand availability at our sole discretion.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at legal@singlespop.com if you suspect unauthorized access to your account. We are not liable for losses arising from unauthorized use of your account.

You may not create more than one account. You may not transfer your account to another person. Accounts created by automated means or on behalf of another person without their consent are prohibited.

4. The Service

SinglesPopis a dating platform that delivers one curated match per day ("balloon") to eligible users. We use automated systems, including artificial intelligence, to select and rank potential matches based on information you provide and compatibility signals we derive from that information.

We do not guarantee that you will receive a match on any given day, that any match will lead to a relationship, or that any information provided by other users is accurate. The Service is provided for personal, non-commercial use only.

5. User Conduct

You agree not to:

  • Provide false, misleading, or inaccurate information in your profile or communications.
  • Harass, threaten, stalk, or intimidate other users.
  • Post or transmit content that is obscene, defamatory, hateful, or otherwise objectionable.
  • Attempt to gain unauthorized access to any part of the Service or another user's account.
  • Use the Service for commercial solicitation, advertising, or spam.
  • Scrape, crawl, or copy any content from the Service without our prior written consent.
  • Use the Service to distribute malware, viruses, or other harmful code.
  • Impersonate any person or entity.
  • Use the Service in any manner that could disable, overburden, or impair our infrastructure.

We reserve the right to remove any content and suspend or terminate any account that violates these rules, at our sole discretion and without notice.

6. User Content

"User Content" means any photos, text, or other material you submit to the Service. You retain ownership of your User Content. By submitting User Content, you grant SinglesPop a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

You represent and warrant that (a) you own or have the necessary rights to your User Content; (b) your User Content does not violate any third party's rights; and (c) your User Content complies with these Terms and all applicable laws.

We may remove any User Content at any time without notice if we believe it violates these Terms or is otherwise harmful.

7. Prohibited Content

You may not upload or share content that:

  • Depicts nudity or sexually explicit material.
  • Depicts minors in any sexual or suggestive context.
  • Promotes violence, self-harm, or illegal activity.
  • Contains another person's private information without their consent.
  • Infringes any copyright, trademark, or other intellectual property right.

8. Paid Features and Credits

Certain features of the Service require balloon credits or payment. All purchases are final and non-refundable unless required by applicable law. We reserve the right to modify pricing, available features, and credit terms at any time with reasonable notice to you.

Credits have no cash value, are non-transferable, and expire if your account is terminated. We are not responsible for credits lost due to account termination for violations of these Terms.

9. Intellectual Property

All content, design, code, trademarks, and branding on the Service (excluding User Content) are owned by or licensed to SinglesPop and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Service content without our express written permission.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

11. Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or applications. We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is at your own risk and subject to their terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY MATCHES, USER CONTENT, OR OTHER INFORMATION ON THE SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SINGLESPOP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless SinglesPop, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

15. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

You may opt out of arbitration by sending written notice to legal@singlespop.com within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

Any arbitration will be conducted on an individual basis; class arbitrations and class actions are not permitted. The arbitration will take place in the United States, and the Federal Arbitration Act governs the interpretation and enforcement of this section.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any claims not subject to arbitration will be brought in the state or federal courts located in Delaware.

17. Termination

We may suspend or terminate your account and access to the Service at any time and for any reason, including violation of these Terms, without notice or liability. You may terminate your account at any time by contacting us at legal@singlespop.com.

Upon termination, Sections 6, 9, 12, 13, 14, 15, and 16 survive.

18. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SinglesPop regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
